OTC advertising still needs the HWG review

Legal requirement — paraphrased

Check section 4 mandatory information and its applicable exceptions. Public medicine ads generally require the statutory risk-information statement in the applicable form. Section 3 prohibits misleading claims; section 11 imposes additional public-advertising restrictions.

Distinguish the risk statement, audiovisual format and reminder exception

Legal requirement — paraphrased

Section 4(3) requires the public risk statement to be readable and separated from other advertising. Section 4(5) specifies audiovisual presentation and television display against a neutral background with simultaneous speech. Use the current German statutory wording.

The reminder-advertising exception in section 4(6) is narrowly defined by permitted content. Adding efficacy claims can take a creative outside that exception; do not assume every short ad qualifies.

Regulator guidance

The EU consumer-protection framework addresses misleading actions and omissions, including an overall deceptive presentation and undisclosed commercial intent. Review benefits, risks, qualifications and prices as a whole under the national implementing law. Space limits do not provide an automatic exemption from material information requirements.

Review at final printed size

Editorial recommendation

Approve the advertorial label, full layout and legibility at actual size. Check what must appear in the advertisement itself before moving details behind a QR code.

Campaign workflow

OTC Medicines: prepare the review

Editorial recommendation

Confirm the exact product qualifies for consumer advertising in this country. Match each indication, dosage and safety statement to the current local product information. Obtain the applicable warning wording and format rules before buying space.

Keep a traceable campaign decision

Editorial recommendation

Keep one review record linking the offer, local market status, claim evidence, exact creative, media settings and any regulatory or professional clearance. Record who checked each condition. Reopen the review when the offer, claim, source rule or execution changes.

Pre-publication checklist

  • Confirm the exact product qualifies for consumer advertising in this country.
  • Match each indication, dosage and safety statement to the current local product information.
  • Obtain the applicable warning wording and format rules before buying space.
  • Record product or provider eligibility before approving claims.
  • Archive the final creative and its evidence, permissions and review decisions.
  • Assign an owner for source updates, complaints and prompt withdrawal of inaccurate material.

Scope and unresolved questions

  • Nordrhein physician rules and the CJEU pharmacy-incentive distinction are documented. Binding dental codes and other Länder remain to be mapped. The exact pharmacy pricing/reimbursement route and product-specific HWG exceptions require the actual campaign facts.
  • This national baseline does not review every broadcaster rule, platform policy, regional licensing condition, promotion mechanic or data-transfer arrangement. No format-specific warning dimensions or durations should be inferred where none are supplied.
Research scope, introduction and dates

For OTC medicines in print campaigns in Germany, confirm the advertising status of the exact product. This framework connects the locally permitted uses with the information, warnings and execution checks relevant to the selected channel.

Printed advertisements must work at their final physical size. Review the advertorial label, required information, images and multipage layout together, including what stays on the page when a QR code points readers elsewhere.

How to use this national baseline

Editorial overview

This framework combines researched national rules with editorial review steps. Federal product-advertising rules plus EU requirements; Länder professional and provider rules need a local check. A visible channel workflow does not establish that the selected product or service may be advertised there. Read the category restrictions first.

The review date identifies when the cited provisions or regulator excerpts were checked. It does not mean that every local rule, exception, professional standard or platform policy has been reviewed.

Your next step: choose a local partner
