Apply the local FSSAI category and claims route

Regulator guidance

Determine the relevant food, health-supplement or nutraceutical category and its rules. FSSAI advertising principles require truthful, non-misleading claims and an appropriate basis. Check claim-specific approval or permitted conditions and later amendments. Do not present a food licence as government endorsement or the food as a substitute for a balanced diet.

Keep advertising consistent with the label and separate licensing from endorsement

Legal requirement — paraphrased

FSSAI regulation 4 requires advertising claims to remain consistent with food labelling, qualifications to be conspicuous and health attributes to be scientifically substantiated. Mandatory display of the FSSAI logo or licence number does not permit using it to promote the product as endorsed.

Do not portray the product as a meal replacement unless its applicable regulatory category permits that positioning. Check the authorised route and specific conditions before adapting a foreign supplement campaign.

Check the complete consumer-facing message

Regulator guidance

CCPA guidance addresses unsubstantiated claims, exaggerated promises and misleading advertisements and endorsements. Review the complete representation and its evidence, including claims made by an endorser. Disclosure or a disclaimer is not a substitute for the substantive conditions of a lawful advertisement.

Disclose the relationship and the health communicator’s role

Regulator guidance

Consumer Affairs’ additional health-and-wellness guidance calls for qualified practitioners and experts to disclose their recognised qualifications. Those presenting themselves as health experts must make clear that endorsements are not a substitute for medical advice, diagnosis or treatment.

The stated general-wellness exception concerns advice unconnected with a specific product or service and not targeting a specific health condition or outcome. A sponsored product claim does not acquire that exception merely by using a wellness label.

Commercial identification, evidence for the claim and the applicable product or professional restrictions remain separate checks.

Separate enactment from commencement

Legal requirement — paraphrased

As of 25 October 2026, do not describe the entire DPDP consent and data-fiduciary regime as operational. The Act notification commences institutional provisions on publication, section 6(9) and section 27(1)(d) after one year, and principal processing, consent, rights and duty provisions after eighteen months.

Rules 1, 2 and 17–21 commence on publication; rule 4 after one year; rules 3, 5–16, 22 and 23 after eighteen months. Read these periods with the December 2025 corrigendum and record the applicable date for the campaign. Phasing does not itself remove other applicable privacy, confidentiality or telecom obligations.

Review the spoken promotion

Editorial recommendation

Assess the host-read wording and audible identification within the recording. Do not assume listeners will open show notes. Decide whether a filmed or broadcast version needs a separate review.

Campaign workflow

Food Supplements: prepare the review

Editorial recommendation

Determine whether the local category is food, natural health product, medicine or another regulated class. Match each claim to the local permitted or notified wording and its composition and use conditions. Assess captions, testimonials and images for an implied treatment or prevention claim.

Keep a traceable campaign decision

Editorial recommendation

Keep one review record linking the offer, local market status, claim evidence, exact creative, media settings and any regulatory or professional clearance. Record who checked each condition. Reopen the review when the offer, claim, source rule or execution changes.

Pre-publication checklist

  • Determine whether the local category is food, natural health product, medicine or another regulated class.
  • Match each claim to the local permitted or notified wording and its composition and use conditions.
  • Assess captions, testimonials and images for an implied treatment or prevention claim.
  • Record product or provider eligibility before approving claims.
  • Archive the final creative and its evidence, permissions and review decisions.
  • Assign an owner for source updates, complaints and prompt withdrawal of inaccurate material.

Scope and unresolved questions

  • Dental provisions and DPDP commencement phases have been added; the current NMC index points to the 2023 abeyance notification restoring the 2002 regime. State clinical establishment and pharmacy rules, AYUSH conduct, current Drugs Rules schedules and later FSSAI claim amendments remain incompletely verified. Check later Gazette amendments and actual product/registration details.
  • This national baseline does not review every broadcaster rule, platform policy, regional licensing condition, promotion mechanic or data-transfer arrangement. No format-specific warning dimensions or durations should be inferred where none are supplied.
Research scope, introduction and dates

Food-supplement promotion in podcasts and digital audio in India begins with local classification. A product sold as a supplement elsewhere may follow a different health-product route here; check the applicable claim conditions before adapting testimonials or benefit statements.

Podcast listeners may hear a promotion without seeing its show notes. Assess audible commercial identification, the host's statements and required spoken information in the recording itself; a filmed podcast also needs a visual-format review.

How to use this national baseline

Editorial overview

This framework combines researched national rules with editorial review steps. Central advertising and health-product baseline; state licensing and profession-specific conditions need local review. A visible channel workflow does not establish that the selected product or service may be advertised there. Read the category restrictions first.

The review date identifies when the cited provisions or regulator excerpts were checked. It does not mean that every local rule, exception, professional standard or platform policy has been reviewed.

Your next step: choose a local partner

Use this framework to brief qualified local legal and regulatory specialists. Ask them to verify current requirements and assess your specific product, service and campaign before acting.
