Email, SMS and direct-message marketing for cosmetics and skincare in Italy

General market orientation, not campaign clearance. Research scope and dates

Product and service rules

Substantiate cosmetic claims for the finished product

Legal requirement — paraphrased

Cosmetic claims must satisfy legal compliance, truthfulness, evidence, honesty, fairness and informed decision-making. Do not imply authority approval or transfer an ingredient’s properties to a finished product without support. Check separately whether the claimed effect changes the product classification.

Channel rules

Check the complete consumer-facing message

Regulator guidance

The EU consumer-protection framework addresses misleading actions and omissions, including an overall deceptive presentation and undisclosed commercial intent. Review benefits, risks, qualifications and prices as a whole under the national implementing law. Space limits do not provide an automatic exemption from material information requirements.

Prior consent and the limited email customer exception

Regulator guidance

Electronic promotional contact normally needs prior consent. The soft-spam exception is limited to the sender’s own analogous offers using an address obtained in a sale, with appropriate information and an effective objection route. Do not extend that email exception automatically to SMS or social messaging.

Review personal data separately from the advertisement

Legal requirement — paraphrased

Identify an Article 6 basis for personal-data processing and an applicable Article 9 condition for health data. Provide appropriate transparency and honour the right to object to direct marketing. Permission to deliver healthcare does not automatically authorise advertising use of patient data; electronic contact and trackers also need their own local review.

Separate promotional and service messages

Editorial recommendation

Review the rules for the actual delivery method: email, SMS and private social messages are not interchangeable. Keep the relevant permission record, accurate sender details and a working suppression process.

Campaign workflow

Cosmetics & Skincare: prepare the review

Editorial recommendation

Check whether the intended use remains cosmetic or triggers a drug, quasi-drug or device route. Hold evidence for the finished-product claim and the advertised conditions of use. Check that retouching, ingredient stories and before-and-after images do not overstate the result.

Keep a traceable campaign decision

Editorial recommendation

Keep one review record linking the offer, local market status, claim evidence, exact creative, media settings and any regulatory or professional clearance. Record who checked each condition. Reopen the review when the offer, claim, source rule or execution changes.

Pre-publication checklist

  • Check whether the intended use remains cosmetic or triggers a drug, quasi-drug or device route.
  • Hold evidence for the finished-product claim and the advertised conditions of use.
  • Check that retouching, ingredient stories and before-and-after images do not overstate the result.
  • Record product or provider eligibility before approving claims.
  • Archive the final creative and its evidence, permissions and review decisions.
  • Assign an owner for source updates, complaints and prompt withdrawal of inaccurate material.

Scope and unresolved questions

  • The Gazette text of the 2023 healthcare-promotion amendment and the Ministry OTC/SOP application procedure are documented. A final consolidated-law check, regional provider conditions and exact authorised social-media functions remain necessary. AGCOM disclosure and registration thresholds do not replace healthcare advertising authorisation.
  • This national baseline does not review every broadcaster rule, platform policy, regional licensing condition, promotion mechanic or data-transfer arrangement. No format-specific warning dimensions or durations should be inferred where none are supplied.
Research scope, introduction and dates

For cosmetics and skincare by email, SMS and direct messages in Italy, start with the intended use and the evidence for the finished product. Review ingredient stories, therapeutic implications and result imagery together so that the presentation remains within the appropriate local category.

Email, SMS and private platform messages can follow different permission rules. Identify the delivery technology and the recipient relationship, then review the promotional content and withdrawal process separately.

How to use this national baseline

Editorial overview

This framework combines researched national rules with editorial review steps. Italian medicine, device and medical-information baseline plus EU requirements. A visible channel workflow does not establish that the selected product or service may be advertised there. Read the category restrictions first.

The review date identifies when the cited provisions or regulator excerpts were checked. It does not mean that every local rule, exception, professional standard or platform policy has been reviewed.
