Health-purpose advertising has restrictions beyond product classification

Legal requirement — paraphrased

Within RD 1907/1996’s scope and subject to its specific-regime provisions, advertising cannot guarantee relief or cure, use professional, celebrity or patient testimonials to induce consumption, or tie supposed preventive or therapeutic effects to the word natural.

Do not suggest that the offer replaces recognised medicines or professional consultation. Genuine patient experience and a commercial disclosure do not remove the applicable prohibition.

Match the advertised service to the centre’s authorisation

Legal requirement — paraphrased

Applies when: The establishment or service falls within Article 6.

Article 6 requires centre and service information to match the health authorisation. It also addresses prior express health-authority authorisation for other advertising. Verify the competent regional authority and the actual authorised activities before promoting an additional treatment.

Regulator guidance

The EU consumer-protection framework addresses misleading actions and omissions, including an overall deceptive presentation and undisclosed commercial intent. Review benefits, risks, qualifications and prices as a whole under the national implementing law. Space limits do not provide an automatic exemption from material information requirements.

Check public exposure and legibility

Editorial recommendation

Review the actual viewing distance, dwell time and location. Treat the placement as public-facing and establish whether the required information can fit legibly; do not shorten mandatory wording without a supported exception.

Wellness & Complementary Therapies: prepare the review

Editorial recommendation

Identify whether the provider is offering lifestyle support or diagnosing and treating a condition. Route advertised supplements, cosmetics, devices and medicines through their own rules. Hold evidence for measurable outcomes and avoid presenting wellness as a substitute for necessary care.

Keep a traceable campaign decision

Editorial recommendation

Keep one review record linking the offer, local market status, claim evidence, exact creative, media settings and any regulatory or professional clearance. Record who checked each condition. Reopen the review when the offer, claim, source rule or execution changes.

Pre-publication checklist

  • Identify whether the provider is offering lifestyle support or diagnosing and treating a condition.
  • Route advertised supplements, cosmetics, devices and medicines through their own rules.
  • Hold evidence for measurable outcomes and avoid presenting wellness as a substitute for necessary care.
  • Record product or provider eligibility before approving claims.
  • Archive the final creative and its evidence, permissions and review decisions.
  • Assign an owner for source updates, complaints and prompt withdrawal of inaccurate material.

Scope and unresolved questions

  • Retained IVD advertising rules, Madrid device-ad approval and provider registration-number requirements are documented. Determine the actual autonomous community before filing; other regional procedures, profession-specific codes and the exact promotion remain to be checked.
  • This national baseline does not review every broadcaster rule, platform policy, regional licensing condition, promotion mechanic or data-transfer arrangement. No format-specific warning dimensions or durations should be inferred where none are supplied.
Research scope, introduction and dates

Wellness marketing on outdoor and place-based displays in Spain needs a clear boundary between lifestyle support and regulated healthcare. Identify any embedded product promotion or diagnostic or therapeutic promise before choosing evidence, testimonials and the final wording.

A poster, digital screen and waiting-room display raise different execution questions. Assess viewing distance, display format and location together, preserving the specific restrictions that can apply inside healthcare or retail premises.

How to use this national baseline

Editorial overview

This framework combines researched national rules with editorial review steps. Spanish national health-advertising baseline plus EU requirements; autonomous-community rules remain relevant. A visible channel workflow does not establish that the selected product or service may be advertised there. Read the category restrictions first.

The review date identifies when the cited provisions or regulator excerpts were checked. It does not mean that every local rule, exception, professional standard or platform policy has been reviewed.

Your next step: choose a local partner

Use this framework to brief qualified local legal and regulatory specialists. Ask them to verify current requirements and assess your specific product, service and campaign before acting.
