Patient data require a separate HIPAA analysis

Regulator guidance

For HIPAA covered entities and business associates, marketing uses or disclosures of protected health information generally require the individual’s HIPAA authorisation, subject to the rule’s definitions and exceptions. Do not assume an ordinary mailing-list opt-in is a compliant HIPAA authorisation.

HHS identifies face-to-face communications and nominal-value promotional gifts as specific exceptions. If marketing involves qualifying third-party remuneration, the authorisation must disclose it. Assess these conditions separately from the advertising claim and any state law.

HIPAA does not cover every wellness business or health app. Its inapplicability does not establish permission under other privacy laws.

California: verify the licence behind a telehealth offer

Regulator guidance

Applies when: California physician telehealth route; other states and statutory exceptions require separate analysis.

For the California route described by the Medical Board, the physician needs a current California licence even when residing elsewhere, and the standard of care is the same as for in-person medicine. A nationwide website or remote consultation technology does not establish permission to treat patients in every state. Identify the patient location and applicable licence before advertising availability.

Channel rules

Review implied claims as well as literal wording

Regulator guidance

FTC guidance assesses the overall impression of health advertising. Hold appropriate scientific evidence before publication; an honest testimonial does not substitute for evidence of the advertised result. Treat imagery and omitted qualifications as part of that assessment.

Disclose a material commercial connection clearly

Regulator guidance

Make payment, free benefits and other material connections clear with the endorsement. Disclosures should be easy to notice and understand, including within videos and repeated where needed in live streams. A profile disclosure or platform tool alone may be insufficient.

Washington health data may be regulated outside HIPAA

Regulator guidance

Applies when: Processing within the scope of Washington’s My Health My Data Act.

Where Washington’s My Health My Data Act applies, collection generally needs purpose-specific consent unless necessary for a requested product or service; sharing requires a distinct consent unless the necessary-service exception applies. Review applicability and exemptions by data and activity, rather than assuming HIPAA status clears advertising tracking. Regulated entities must prominently link a separate consumer health data privacy policy from the homepage.

Review the spoken promotion

Editorial recommendation

Assess the host-read wording and audible identification within the recording. Do not assume listeners will open show notes. Decide whether a filmed or broadcast version needs a separate review.

Campaign workflow

Medical Treatments & Services: prepare the review

Editorial recommendation

Define the actual treatment and who is authorised to provide it. Separate evidence of a possible benefit from a promise of an individual result. Explain material limits, costs and eligibility without creating pressure for unnecessary care.

Keep a traceable campaign decision

Editorial recommendation

Keep one review record linking the offer, local market status, claim evidence, exact creative, media settings and any regulatory or professional clearance. Record who checked each condition. Reopen the review when the offer, claim, source rule or execution changes.

Pre-publication checklist

  • Define the actual treatment and who is authorised to provide it.
  • Separate evidence of a possible benefit from a promise of an individual result.
  • Explain material limits, costs and eligibility without creating pressure for unnecessary care.
  • Record product or provider eligibility before approving claims.
  • Archive the final creative and its evidence, permissions and review decisions.
  • Assign an owner for source updates, complaints and prompt withdrawal of inaccurate material.

Scope and unresolved questions

  • California physician telehealth and Washington consumer-health-data requirements are now documented as scoped examples. Other state medical/dental/pharmacy rules, corporate practice, fee splitting, referral arrangements and state telemarketing laws remain to be assessed for the actual provider and patient location.
  • FDA television/radio-format standards and a scoped Washington health-data rule are documented. Exact TCPA revocation implementation dates and post-litigation consent text were not fully verified from accessible primary documents; final SMS clearance remains open. Platform, broadcaster and other state rules depend on the actual execution.
Research scope, introduction and dates

Promoting a medical treatment in podcasts and digital audio in the United States requires a precise description of the service and who provides it. Connect the evidence for possible benefits with realistic patient expectations and the applicable professional advertising conditions.

Podcast listeners may hear a promotion without seeing its show notes. Assess audible commercial identification, the host's statements and required spoken information in the recording itself; a filmed podcast also needs a visual-format review.

How to use this national baseline

Editorial overview

This framework combines researched national rules with editorial review steps. Federal advertising baseline; state professional, pharmacy and privacy rules require a separate review. A visible channel workflow does not establish that the selected product or service may be advertised there. Read the category restrictions first.

The review date identifies when the cited provisions or regulator excerpts were checked. It does not mean that every local rule, exception, professional standard or platform policy has been reviewed.

Your next step: choose a local partner

Use this framework to brief qualified local legal and regulatory specialists. Ask them to verify current requirements and assess your specific product, service and campaign before acting.
