Separate FDA labelling routes from FTC advertising evidence
Regulator guidance
Dietary-supplement structure/function labelling has evidence, FDA notification and disclaimer conditions. Disease-risk health claims and nutrient-content claims have different routes. Do not treat a label disclaimer as permission to make deceptive advertising claims; assess the advertisement’s overall message separately.

Match the evidence to the precise advertised benefit
Regulator guidance
Applies when: The claim falls within FTC health-advertising oversight; FDA product-specific requirements also need review.
FTC guidance generally expects randomised controlled human clinical testing for health-benefit claims, with design and quality appropriate to the claim and the scientific field. Animal studies or consumer anecdotes alone do not establish human benefits.
Assess the actual formulation, dose, population and outcome. An ingredient study or a clinically tested claim must not imply a proven finished-product effect that the evidence does not support.

Channel rules
Review implied claims as well as literal wording
Regulator guidance
FTC guidance assesses the overall impression of health advertising. Hold appropriate scientific evidence before publication; an honest testimonial does not substitute for evidence of the advertised result. Treat imagery and omitted qualifications as part of that assessment.
Washington health data may be regulated outside HIPAA
Regulator guidance
Applies when: Processing within the scope of Washington’s My Health My Data Act.
Where Washington’s My Health My Data Act applies, collection generally needs purpose-specific consent unless necessary for a requested product or service; sharing requires a distinct consent unless the necessary-service exception applies. Review applicability and exemptions by data and activity, rather than assuming HIPAA status clears advertising tracking. Regulated entities must prominently link a separate consumer health data privacy policy from the homepage.

Check public exposure and legibility
Editorial recommendation
Review the actual viewing distance, dwell time and location. Treat the placement as public-facing and establish whether the required information can fit legibly; do not shorten mandatory wording without a supported exception.
Campaign workflow
Food Supplements: prepare the review
Editorial recommendation
Determine whether the local category is food, natural health product, medicine or another regulated class. Match each claim to the local permitted or notified wording and its composition and use conditions. Assess captions, testimonials and images for an implied treatment or prevention claim.
Keep a traceable campaign decision
Editorial recommendation
Keep one review record linking the offer, local market status, claim evidence, exact creative, media settings and any regulatory or professional clearance. Record who checked each condition. Reopen the review when the offer, claim, source rule or execution changes.
Pre-publication checklist
- Determine whether the local category is food, natural health product, medicine or another regulated class.
- Match each claim to the local permitted or notified wording and its composition and use conditions.
- Assess captions, testimonials and images for an implied treatment or prevention claim.
- Record product or provider eligibility before approving claims.
- Archive the final creative and its evidence, permissions and review decisions.
- Assign an owner for source updates, complaints and prompt withdrawal of inaccurate material.
Scope and unresolved questions
- California physician telehealth and Washington consumer-health-data requirements are now documented as scoped examples. Other state medical/dental/pharmacy rules, corporate practice, fee splitting, referral arrangements and state telemarketing laws remain to be assessed for the actual provider and patient location.
- FDA television/radio-format standards and a scoped Washington health-data rule are documented. Exact TCPA revocation implementation dates and post-litigation consent text were not fully verified from accessible primary documents; final SMS clearance remains open. Platform, broadcaster and other state rules depend on the actual execution.
Research scope, introduction and dates
Food-supplement promotion on outdoor and place-based displays in the United States begins with local classification. A product sold as a supplement elsewhere may follow a different health-product route here; check the applicable claim conditions before adapting testimonials or benefit statements.
A poster, digital screen and waiting-room display raise different execution questions. Assess viewing distance, display format and location together, preserving the specific restrictions that can apply inside healthcare or retail premises.
General market orientation, not legal, regulatory or medical advice, a complete compliance plan or clearance of an advertisement. Actual requirements depend on the specific offer and campaign.
How to use this national baseline
Editorial overview
This framework combines researched national rules with editorial review steps. Federal advertising baseline; state professional, pharmacy and privacy rules require a separate review. A visible channel workflow does not establish that the selected product or service may be advertised there. Read the category restrictions first.
The review date identifies when the cited provisions or regulator excerpts were checked. It does not mean that every local rule, exception, professional standard or platform policy has been reviewed.
